City Council Special Call Meeting

Notice is hereby given that the City of Hendersonville City Council will hold a Special Call Meeting on Friday, July 2, 2021, at 9:00 a.m., in the City Operations Assembly Room located at 305 Williams Street, Hendersonville NC to consider the following three public hearings:

 

  1. Land Development Regulations Text Amendments Proposed for Conformance with Chapter 160D of the North Carolina General Statutes – Text amendments are proposed for land development regulations for the City of Hendersonville for conformance with Chapter 160D of the North Carolina General Statutes. The land development regulations proposed for amendment include:

 

The Subdivision Ordinance

The Zoning Ordinance

Chapter 24, Article II of the Code – Flood Damage Prevention Ordinance

Chapter 24, Article III of the Code – Stormwater Ordinance

Chapter 12 of the Code – Buildings and Building Regulations

Chapter 28 of the Code – Historic Preservation, including also:

Historic Preservation Commission Residential Standards and

Historic Preservation Commission Main Street Standards

Chapter 40 of the Code – Planning and Development

 

The purpose for the proposed amendments is to readopt and update these ordinances for conformance to Chapter 160D of the North Carolina Statutes, including but not limited to clarifications and changes to land development law adopted by N.C. Sess. Laws 2019-111, 2020-3, and 2020-25.  Changes include, but are not limited to, procedures, notices, conflict of interest, terminology, definitions, statutory references, clarifications, period of validity for development approvals, vested rights, permit choice and other conforming changes.

  1. Zoning Map Amendment – S. Whitted St. (P21-18-RZO) - Application for a zoning map amendment from William Shaffer. The applicant is requesting to rezone the subject properties, PIN 9568-46-9083, 9568-45-9994 and 9568-55-0841 and located on S. Whitted Street, from I-1, Industrial and R-15, Medium Density Residential to R-6, High Density Residential.

 

  • Zoning Map Amendment – Monroe & Asheville Highway (P21-36-RZO) - Application for a zoning map amendment from Larry R. Maitland and Mary Ann Maitland. The applicant is requesting to rezone a portion of the subject property PIN 9569-36-9825 and located at the corner of Asheville Highway and Monroe Drive, from R-10, Medium Density Residential to C-3, Highway Business.

The Mayor and City Council Members will attend the hearings in person.  Public hearing comments will be accepted from those attending in person at the designated time at this meeting. The public may also view and verbally comment during this public hearing live via ZOOM.  For security reasons screen sharing will not be allowed. The meeting instructions to join by Zoom will be available on the City’s website by visiting https://www.hendersonvillenc.gov/events-calendar. Comment period instructions will also be displayed at the appropriate times during the meeting.

Anyone wishing to submit digital comments for the public hearings prior to the meeting may visit https://www.hendersonvillenc.gov/comment to submit their comment. Digital comment submissions for public hearings must be received by 8:00 a.m.  on July 1, 2021, to be considered by the City Council in accordance with the City’s Public Comment Policy and security protocols. All comments and materials submitted are considered public records as defined in §132.1.
